According to Article 130 of the Russian Civil Code, real estate includes land parcels, subsoil plots, isolated water bodies, and everything firmly attached to land, i.e. the objects that cannot be removed without causing incommensurate damage to their function, including forests, perennial plantings, buildings and structures. It should be noted that the Russian Civil Code also classifies aircraft, sea-going vessels, inland-navigation vessels and space devices as real estate. 
Classification of the subject property as real estate for valuation purposes and the classification given in the Civil Code have certain differences. Real estate as the subject of valuation first of all includes land as a physical object and everything firmly attached to land. Consequently, the subject of real estate valuation is a land parcel, which may have the following as its integral part:

  • a building (structure) or a group of buildings (structures) located on the parcel;
  • isolated water objects, perennial plantings;
  • engineering structures and services connecting the parcel and the buildings (structures) located on the parcel to local infrastructure facilities;
  • permanent site improvements;
  • business, transport and engineering support facilities relating to the property but located outside the boundaries of the parcel;
  • other objects which, together with the above-listed real property items, make up an indivisible constructive or functional whole.
In addition to valuation of the ownership right, the appraiser can also estimate the market rental rate for the subject property. This may be necessary in order to observe both the landlord’s and the tenant’s interests when the property is leased out. In the case of federal or municipal immovable property, the requirement for the market rental rate determination is established by applicable documents. Thus, according to Order of the Russian Ministry of Property No. 1185-r of May 13, 2002 “On the determination of annual rental rate for federal immovable property located in Moscow”, “…the rental rate for the … property is established in accordance with the annual rent specified by an appraiser in the market value determination for the demised property.”
