THE VALUATION CORP. CONDUCTS PATENT AND INDUSTRIAL DESIGN VALUATIONS IN MOSCOW, RUSSIA, AND OTHER RUSSIAN REGIONSA patent is defined as a document issued by a competent government authority for a certain period, which certifies the authorship of and an exclusive right to an invention and grants the patentee the ownership title for the invention. The first step in a patent valuation is to analyze the documents establishing the right to the property being valued. Certainly, first of all this is the patent itself and its description. However, these documents do not always give a full picture of the essence and legal rights to the property. Granted licenses, lawsuits or other encumbrances on the subject patent can substantially affect the value estimate. Due to the lack of a public market for intellectual property (in particular for patents and licenses) the appraiser is unable to determine the patent value using transaction prices for similar properties or at least to make comparisons with offered purchase or sale prices. Therefore, the main approaches used in patent valuations are the cost approach, which is based on an analysis of incurred expenses, and the income approach, which determines the income received (or expected to be received) from the use of the subject patent. The key problem in a cost-based patent valuation is that the historical expenses do not give us information on the invention utility (efficiency), fitness for commercial use and earning capacity. And it is only the use of income approach methods, calculation of the actually received (or expected) income, which necessarily capture the contribution of the subject patent, that make it possible to determine the real value. Analysis of the income generated by the subject patent is especially important and undoubtedly necessary to arrive at the market value of the patent.
